Terms and conditions of multi-year warranties provided by CM Trade Via
CM Trade Via s.r.o. (hereinafter referred to as the "Provider") provides a quality guarantee for selected products beyond the scope of statutory liability for defects. This quality guarantee is provided under the following conditions:

Statutory Liability for Defects: During the term of the statutory liability for defects, which is governed by the relevant provisions of the Civil Code, the buyer has rights from defective performance to the extent provided by law. These rights are not affected by the quality guarantee provided by the Provider.

Scope of the Quality Guarantee: The Provider guarantees that the product covered by the quality guarantee will be fit for use for its usual purpose and will retain its usual characteristics throughout the specified warranty period.

Duration of the Quality Guarantee: The quality guarantee runs concurrently with the statutory liability for defects and expires on the day and month identical to the date of purchase, following the expiration of the number of years corresponding to the length of the provided guarantee. The date of purchase is considered the date stated on the original sales document.

Conditions for the Quality Guarantee:

If the quality guarantee is provided automatically upon purchase of the product, the right to this guarantee arises at the moment of purchase.

For products where registration is a condition for providing the quality guarantee, the buyer is obliged to register the product on the website designated by the Provider within the period set by the Provider; otherwise, the right to the quality guarantee shall not arise.

Warranty Exclusions: The quality guarantee does not cover the following cases:

Accessories (e.g., charging adapters, batteries, inhalation masks, mouthpieces, filters, blood pressure monitor cuffs, etc.).

Product parts subject to wear and tear through normal use or other natural wear.

Product defects caused by failure to follow instructions for use, use contrary to the intended purpose, abnormal environmental conditions, inappropriate operating conditions, improper maintenance, or treatment.

Product defects caused by the use of non-original accessories, additions, or spare parts.
-
Products on which unauthorized changes or other modifications have been performed, or which have been partially or completely disassembled.

Defects caused by mechanical damage, connection of the product to a power voltage other than prescribed, the influence of an unavoidable event (e.g., natural disaster), or other circumstances not covered by statutory liability for defects.

Product defects (damage or incompleteness of delivery) due to which the product was sold to the buyer at a discount.

Consumables supplied with the product.

Filing a Claim:

The buyer is obliged to file a claim with the Provider during the warranty period.

The claimed product must be delivered to the address of the Provider's claims department (view current contacts) along with a copy of the sales document stating the date of purchase and product designation. The document does not need to be sent by a buyer who used the option to upload the document during online warranty registration.

Transport costs incurred during the handover of the product by the customer for a claim are borne by the Provider throughout the warranty period.

Claim Settlement:

The Provider or its designated service center will assess the claim and decide on the method of its settlement.

In the event of a defect that can be removed, the buyer has the right to its free removal.

If repair is not possible or practical, the buyer has the right to have the product replaced with a new, defect-free product. In such a case, the original product becomes the property of the Provider.

In the event of a product replacement with a new one, a new warranty period does not begin.

The period for settling a claim is a maximum of 30 days from the day the claim was filed by the buyer.

The warranty period is extended by the time during which the buyer could not properly use the product due to the ongoing claim procedure.

The Provider reserves the right, in case of product unrepairability, to replace it with another product of comparable or better technical parameters. If the buyer does not agree to the replacement, they have the right to request the Provider for free disposal of the unrepairable product or for its return. The buyer does not have the right to claim the product repeatedly for the same defect that was previously designated as unrepairable by the Provider.

These warranty conditions do not provide the buyer with the right to withdraw from the purchase contract and receive a refund of the purchase price.

The buyer does not have the right to be provided with a replacement product during the claim settlement period.

Changes to Warranty Conditions: The Provider reserves the right to change these warranty conditions without prior notice.
